Obtaining a work permit in Curaçao
A work permit in Curaçao is a fundamental requirement for foreigners to be able to work legally on the island. Curaçao is an island located in the Caribbean and is an autonomous territory within the Kingdom of the Netherlands, so it has its own regulations regarding immigration and employment. Below is a basic guide on how to obtain a work permit in Curaçao:
Basic requirements:
- Valid passport: You must have a valid passport with at least six months of validity.
- Job offer: You must have a job offer from a company in Curaçao before applying for a work permit.
- Entry visa (if applicable): Depending on your nationality, you may need to obtain an entry visa to Curaçao in order to come and take your permit in person.
1. Obtaining an offer of employment:
- Search for jobs in Curaçao through online job portals, recruitment agencies, or directly contact companies that interest you.
- Once you have received an offer of employment, it will be up to the company to apply for a work permit on your behalf with the Curaçao Department of Social Affairs and Labor.
2. Application process:
- The employing company must file an application for a work permit with the Curaçao Department of Social Affairs and Labor.
- The application must include documents such as your employment contract, your resume, a copy of your passport, among others.
- It is important to note that in Curaçao, labor laws seek to give priority to the labor force of its local inhabitants. The work permit will be granted if the work to be performed corresponds to a specialty not available on the island. The company is aware of this and will be advised during the process of advertising the vacancy.
- The company must also pay the corresponding fees for the work permit (although in many cases, the company will also be able to negotiate this with the prospective employee while the employee is on probation).
Processing time:
- To begin, the company or employer must post a vacancy with the Department of Labor. Such a vacancy must be posted for 5 weeks before the employer can officially apply for a work permit. This is a protocol to ensure that priority is given to locals before foreigners. There is no cost to the employer for this process.
- Once the vacancy is considered viable for hiring a foreigner, the company has the right to officially apply for a work permit in favor of the interested party. The approval of such a permit may take 5-9 months. It is therefore important to plan this process in advance.
- The cost of a work permit is normally around 1000 guilders for a full year . This proof of payment for the permit must be included in the documentation submitted by the employer.
4. Residence permit:
Even if you have an approved work permit, you must obtain a residence permit to come and live on the island.
- Once the work permit is approved, the foreigner may apply for a residence permit for work on the island. The residence permit for work purposes costs 525 guilders. Proof of payment must be included in the documentation for the residence permit application.
- You must wait for the residence permit in your home country. If you remain on the island while the residence permit is being processed, there is a high probability that the petition will be rejected. Do not fall into the trap of staying on the island while the residence permit is pending. Plan and budget for this ahead of time so that you can work/subsist in your home country until you get confirmation that the permit is ready.
5. Private health insurance:
- Foreigners who obtain a work and residence permit must have a private medical insurance. This insurance is one of the documents that you will have to present in order to receive the residence permit in your hands. Some of the recommended insurances are: GC United, Citizens Insurance.
5. Renewal of work permit:
- If your work contract is extended or you wish to change employers, the employer must apply for a renewal of your work permit before your previous one expires.
8. Compliance with labor laws:
- Once you obtain your work permit, be sure to comply with all Curaçao labor laws, such as minimum wage, working hours and working conditions.
9. Legal advice:
- It is advisable to seek legal advice or consult with the immigration authorities in Curaçao to obtain updated information on the requirements and the process of obtaining a work permit in your particular case if you need to bring your partner or children.
Keep in mind that the regulations and requirements for obtaining a work permit in Curaçao may change over time, so it is essential to verify the latest information before starting the process. Consulting with local authorities or an immigration lawyer is a good way to make sure you are aware of the current requirements.
